Warranty & Guarantee Policy

1. Overview

    • Enacted in 2009, the Consumer Protection Act was drafted and later adopted with the main objective being to promote a fair, accessible, and sustainable marketplace for consumer products and services.

    • In light of this, the Consumer Protection Act gives rights, duties, and obligations to both consumers and suppliers as main role players in the marketplace. These rights, duties, and obligations govern commercial transactions as well as the goods and services which form part of those transactions.

    • One of the rights granted by the Act is the consumer’s right to fair value, good quality, and safety. This right encompasses amongst others the rights, duties, obligations, and procedures applicable to warranties where the consumer purchases goods or services and warranties in respect of repairs and returns.

2. Scope

    • This policy applies to all consumers (and/or anyone whom they authorize to act on their behalf) who enter and complete transactions with The Company for the purchase of products or services.

These transactions must take place in the ordinary course of business and not fall into one of the categories of exemption.

3. Applicable Legal Principles.

    • Implied Warranty

        • In the sale or supply of any goods or services, the supplier must warrant that the goods or services comply with the standards of being safe, durable, and of good quality.

        • The Act outlines the requirements for what safe and good quality goods are (i.e. the goods must be safe, reasonable quality, and not defective)

        • If the supplier does not meet the requirements as set out in the Act, the consumer may within six months of purchase return the goods/services to the supplier.

        • The consumer can return the goods without penalty and at the supplier’s risk.

        • If the consumer returns goods to the supplier due to any of the factors above, the supplier must:

            • Repair or replace the goods;

            • Refund the price paid by the consumer.

        • In the instance that the supplier opts to repair the returned goods and within three months of repair the defect is not fixed or there is a further failure, the supplier must:

            • Replace the goods;

            • Refund the price paid by the consumer.

        • Warranty on the repair of goods

            • When a supplier undertakes maintenance or repair work, they must warrant any part which is used for a minimum of three months or longer which they must specify in writing.

            • The warrant regarding parts during maintenance entails that the parts are of good quality and effective for the purposes they are intended.

            • The following applies to the warranty:

                • The warranty must be consistent with any other warranties given by the supplier(implied, express, or deemed);

                • The warranty will be void if the consumer has abused or misused the part

            • The above provision does not apply to ordinary wear and tear of a part.

4. Policy Statement

    • The following policy statement(s) shall be applicable to all transactions between the Company and its Consumers.

    • A warranty will be voluntarily offered by the company and is separate and in addition to the legal rights of consumers under applicable South African laws governing the sale of consumer goods and to any rights of the consumer against the original retail seller of the Product and, therefore, does not affect, change, or replace such rights.

    • Products covered Warrant.

    • The company warrants that all Products are free from defects in materials and workmanship under normal use and in accordance with the respective Product user manual, during the Warranty Period (defined below).

    • The warranty shall valid for the following periods;

        • Within two (2) months , from the date of original purchase of the Product (the “Warranty Period“).; and

    • The company’s obligation in event of a Warranty claim

        • During the Warranty Period, the company or any other authorised person will repair or replace, at the company’s discretion, the Product, or any relevant parts thereof in the event of any defect in the materials and workmanship.

        • The repaired Product (or part) or the Product (or part) provided as a replacement for a defective Product (or part), shall be free from defect in materials and workmanship. Repair or replacement of a Product or part may involve the use of a functionally equivalent reconditioned unit.

        • The consumer shall not be charged (whether for parts, labour or otherwise) for the repair or replacement of a defective Product during the Warranty Period. All replaced defective Product, parts or equipment shall become the property of the company after the defective Product has been replaced or repaired.

        • The Warranty in respect of a repaired or replaced Product or part shall continue for the remainder of the Warranty Period of the Product, which was repaired or replaced or, for three (3) months from the date of repair, whichever is longer.

        • The consumer will be required to provide the original invoice and proof of payment or other documentation, or information requested or required by applicable legislation in respect of the date and place of purchase. In the event that such information is not presented or if it is incomplete or illegible, the company reserves the right to refuse providing the above service in respect of any Warranty claim.

    • Product and items not covered by the Warranty

        • This Warranty does not cover defects and damage resulting from the following:

            • Normal wear and tear of the equipment or otherwise due to the normal aging of the equipment.

            • The Product being used other than in a normal and customary manner.

            • Any disassembly, repair, alteration, or modifications carried out by anyone other than the company or an authorised service provider.

            • Misuse, abuse, negligence, or an accident howsoever caused.

            • Improper testing, operation, maintenance, installation, or any alteration or modification of the Product.

            • Scratches or damage to surfaces and all other externally exposed parts due to normal use.

            • Use outside of use permitted under the Product’s user manual.

            • In the case of machinery, the use of any and all parts not supplied by the company.

        • The Warranty will not be available in the following instances:

            • If the serial number or warranty seal on the Product is illegible, has been defaced or removed; or,

            • Without any proof of purchase provided by the consumer to the company.

        • The Warranty applies to the Product as originally supplied. The Warranty does not apply to any software or other equipment owned by the company or third parties however, you should check the end-user license agreement, separate warranty/ guarantee statement(s) and/,or any exclusions which are provided or intended to apply to such items.

5. Enforcement

An employee found to have violated this policy may be subject to disciplinary action, up to and including termination of employment. A violation of this policy by a temporary worker, contractor, or vendor may result in the termination of their contract or assignment with The Company.
